Legal Question in Insurance Law in California

Who's responsible in a dual-fault accident?

I was recently involved in an accident in which the police officer said that it was a ''dual-fault'' accident. If this is true, then how do you handle it with insurance companies since we both have insurance.

responsibility would be allocated on a pro rata basis per % of fault. insurance companies do this everyday.

Re: Who's responsible in a dual-fault accident?

Thanks for your question. Please keep in mind that a police officer's opinion about causation is not necessarily a final determination. He/she is basing the opinion on statements and evidence at the scene and may be hearsay and inadmissible.

I will be glad to discuss the facts and review the police report for you at no charge.

Please call me at (800) 500-0602. Thank you.
