Legal Question in Insurance Law in California
SCIF Physical Audit Rights
State Fund (SCIF) has demanded a physical audit of my payroll records. They want to see time cards, check stubs, check registers, payroll journals, rtc. In addition, they have requested contact info for each of my employees.
I need to know what privacy rights I have as an employer, and what actual rights/authority SCIF has to access my records. What if I choose not to comply with the audit?

Your policy should provide that the insurer has the right to audit you. The law also give it the right to do so, and there are potential civil and criminal penalties for misrepresentions which affect the rating of employees, etc. You might consider retaining an attorney before this gets out of hand.
