Legal Question in Insurance Law in California

Settlement for 'Inconvenience' in Auto Accident

I was hit by a driver determined to be 100% at fault (California). I suffered mild symptoms (headache, stiff neck, etc.) which lasted less than a week and I did not see a doctor. The accident occurred on a weekend, so I missed no work, but it did disrupt my weekend. Shouldn't the insurance company typically offer, as part of the settlement, compensation for this 'disruption' of my plans and the hours of inconvenience (filling out forms, getting estimates from repair shops, dealing with a body shop, phone calls, etc.)?? I'm self-employed -- can I ask for an amount equal to the time lost based on my normal billing?

Thanks

Re: Settlement for 'Inconvenience' in Auto Accident

Thanks for your question. As you are learning, the insurance company is not your friend. Since You have no pain, your pain and suffering will be very limited. They probably are not liable for your lost weekend or inconvenience, but you are entitled to lost work. I can't tell from your question if you missed work due to being hurt and unable to work or because you spent time with calls, repairs, etc.

I would be glad to discuss the matter with you. Please call me at (800) 500-0602. Thank you.
