Legal Question in Insurance Law in California

Susceptibility of Life Insurance Claim

My father recently passed away, and in his living trust with his 13 year girlfriend he designated that she would be able to keep everything.

The only thing that I should be entitled to receive is half of his 100K life insurance policy.

His girlfriend is really dragging her feet in giving me the information about the policy and I am concerned that she may try to use my portion of the money to pay off his debts.

Can she touch this money?

Thanks.

Re: Susceptibility of Life Insurance Claim

If you are the beneficiary, no. But if she gets

the money and uses it, your money is only as good

as a lawsuit against her/the trust. Contact a

lawyer immediately. There are ways to get the

information. You may consider contacting the lawyer

who did the trust as he will represent her, but

probably won't lie to you to protect her. First get a

copy of the trust and see exactly what rights you

have. What about the will?

Call me if you want to discuss this.
