Totaled car

I was involved in a car accident where the man ran a red light. His claim's adjuster says his client's policy over covers $5,000 and my totalled car and rental bill is $8,500. I don't know if the adjuster is telling the truth. Is it worth it to take his client to court for the additional money (considering lawyer's fees, etc). What would you recommend?

Get a copy of the defendant's policy. That

is the only way you will know if the adjuster is telling you the truth. Since the exess is only $3,500, I assume that is only for the property damage, right? Did you have any injuries? If you experienced any, and even if you do not have any medical bills, you may be able to obtain a settlement for "pain and suffering". That liability limit is not limited to the $5K, which is the statutory minimum for property damage. The statutory minimums for injury are $15K per person and $30K per accident.
