Legal Question in Insurance Law in California

Uninsured

My brother was involved in an accident and he does not have a drivers license. The car is registered in my mother's name. The other driver's insurance company continues to call my mom and cliams that she is liable for the accident since the car is under her name. Also, the police report states that there was only paint transference and the officer could not determine who was at fault. Since my mother is a single parent, she has tried to explain to the insurance company that she cannot afford to pay them. The insurance is asking my mother to pay $2,500 since her financial situation is difficult.

Is my mother liable and should she pay $2,500?

As the owner she has liability for property damage to another vehicle up to $5,000.00. She may be forced to pay. That said she should get a copy of the insurer's damage estimate before she agrees to anything. She may be able to work out a payment plan.
