Legal Question in Insurance Law in California

Vehicle totalled by Parking Garage

In moving my car, parking attendant crashed and totalled my vehicle. I park in a high-rise bldg where it is common to leave keys for attendant to move your car. Parking company wants to pay car's value as based on Kelley BB and local dealer quotes and tells me that is all they are entitled to pay. Is there such a law and if not, how best to proceed?

Re: Vehicle totalled by Parking Garage

The parking company is only required to reimburse you for the actual value of your car. If you think it has underestimated the car's value you will need evidence to support your position.

They owe you the fair market value of the car, not the blue book. Fair market value is determined by figuring out what your car is selling for in your area. I have a free report on determining the value of your vehicle and you can get it by emailing me at [email protected] and asking for my total loss report.
