water damage to neighbor's condo

I am an owner/landlord of a condo where there is a leak from the bathroom to the ceiling of neighbor downstairs. The plumber could not determine the source, possibly either the toilet or water splashing from shower. Would our homeowners insurance cover his ceiling repairs? The renter in our condo does not have renters insurance.

The answer will depend upon what your policy says and where the leak is coming from. The HOA might also be responsible for the damages depending upon where the leak is coming from and the terms of the HOA agreement. For example, in some condo complexes leaks within the walls are the HOA's responsibility while leaks from pipes and appliances within a unit are the owner's responsibility.
