Legal Question in Intellectual Property in California

Attorney who falsely claims to represent a client

Hi,

A friend of mine was contacted about an intelectual property issue (domain name) from an attorney who claimed to represent a trademark holder. Upon investigation it has been found that the trademark holder does not even know the attorney at all. My friend thinks that the attorney was making this claim on behalf of another company in an effort to take away the domain name in question.

Isn't that illegal? What can be done to discipline that attorney if this is true? Should he complain to the local bar association?

Thanks in Advance.

Re: Attorney who falsely claims to represent a client

Ask the attorney to put everything in writing. Then send a copy to the non-client. They will probably then take care of the issue as it relates to reporting him to the state bar.

Re: Attorney who falsely claims to represent a client

The trademark owner can report him for false representation to the state bar in the state where the attorney is licensed.
