Legal Question in Intellectual Property in California
I am in Calif. In Feb., I hired a Print On Demand company with a so-called good reputation ,in Fla., to publish my debut book.
They have manipulated, bullied, and mostly said yes to my every request, then did it their own way. I paid the fees in 3 installments.
The supposedly final look see at the book cost me another $20. It is not at all acceptable. They won't give me what I ordered and won't refund my money for services not rendered according to their verbal and written agreements and their website promises.
No entity rules book publishers.
I'm a senior who wrote a book to help seniors. I know it's not a money maker, but I hoped to get at least some of my investment back, while helping others.
Is this also age discrimination?
What can be done?
1 Answer from Attorneys
Although I am unaware of a specific entity governing book publishers, they are a business which are governed by the commercial code like all other business. You should review the agreements you have with the company and depending on how much investment you are looking to lose you should contact an attorney as there could be a claim under contracts.
As for age discrimination, it is hard to determine from the facts you have given if there is such a case. Discrimination usually arises when one classification is treated different from others. From your facts, I cannot ascertain whether they were treating you different from how they threat other people of different age groups.
