Legal Question in Intellectual Property in California

car accident

Recently an acquaintance of mine who i allowed to use my car for a day while I was out of town (told she had a driving permit when she really didnt) totaled my car. We made an agreement which she signed. She paid me half of the 3500 owed and is due on the other half soon. She is now refusing to pay me the other half I would just like to know what are my options. Can i press charges?

"press charges" suggests some kind of criminal case... so you probably can't do anything on that front... but you have an agreement (i.e., a contract), by which your friend agreed to pay. The later refusal to pay is a breach. BUT, this will come down to he-said/she-said, unless your agreement is in writing. If so... head for small claims court and collect your money. If not... it depends on who's more believable....
