Legal Question in Intellectual Property in California
copyright infringement
Last year I wrote a script that I was intending to make into an independent short film. During Thanksgiving of 2006 I asked a friend of the family, an English teacher, to proof read my script. Last week I found out that this person wrote a copy of my script and then had it copyrighted with the Library of Congress. Now if I make my film they will sue me for copyright infringement or make me pay them royalties. What can I do to get the copyright to my script back? I mailed myself a copy of my script before this happened, can I use that as proof that the script is mine?

Re: copyright infringement
You have some options here. You have certain copyrights once the script is fixed in a tangible medium, i.e., put to paper. However, there are certain things that you should do to protect those rights.
You should probably have a consultation with an attorney to discuss your rights and options.
