Legal Question in Intellectual Property in California
Copyright Procedures
I would like to re-publish the works of an author who lived from 1850 to 1919. 1. I would like to know if anyone owns the copyright of her work. 2. If not, how can I go about "owning" it? 3. Should I own the copyright before re-publishing this material? Note: All of her works are out of print and I can not find any relatives of her.

Copyrite Question on Old Works
If the copyright has not been renewed, it is mostlikely no longer in effect. The main questions is ifthe "works" would be viewed "in the public domaine"
If so, then no one can "own" them. As for how can you "Own" the works.
A copyrite can normally be obtained by the original author, or someone who adds to thepreviously copyriten materials. Therefore, it isunlikely that you can obtain a copyrite on these matererials.============================================================If applicable to this message: "This transmission does not create an attorney-client relationship.
