Legal Question in Intellectual Property in California

Copyrights of a photo

I was hired to take pictures for a chamber of commerce. Someone outside of the chamber used one of the pictures, without my permission or the permission of the chamber, to promote his business.

What are my rights to compensation, copyright law etc?

Re: Copyrights of a photo

Without knowing the actual agreement between you and the Chamber, it sounds like the Chamber hired you and is the owner of the pictures. That would leave you without recourse. Feel free to enlighten me with more facts.

Thank you.

It depends on who the copyright owner is, you or the Chamber. If it is deemed a work for hire, then the Chamber would be. Further, in terms of pursuing a legal claim, you need to have your works filed with the US Copyright office.
