Copywrite laws concerning cemetery artwork

I am an Artist who photographs and then does renderings of Cemetery statuary. I know artwork is normally copywrited, but what are the laws governing cemetery statuary that is mass produced...is it public domain?

Good news for you. Cemetery statuary is copyrighted (copyright is automatic upon creation of a work in tangible form) but seldom enforced. I think your risk is minimal if all you are doing is making photographs and paintings. On the other hand,if you are duplicating the statues for sale as cemetery statuary, you are hanging out there legally. Are you aware you may have your own copyright in the renderings you are creating?
