Legal Question in Intellectual Property in California

Delaware LLC

Hello,

I'm forming an ecommerces store. I'm a sole properitor at this time and I've formed an LLC in Delaware with a Registered Agent. I plan to use drop shippers and they ask for a resellers, retail id. Isnt that the same as a state ID? I'm in California physically do I need to get on for California even though my LLC is recorded in Delaware?

Re: Delaware LLC

A resale certificate is issued by the state taxing authority in the state where your business is physically located, not where it was formed. It gives you authority to collect sales tax from your customers (and avoid paying tax on raw goods you're going to sell). In California, you need to file with the Board of Equalization. Their website can give you details. You would not need to get this permit in any state where you do not have a physical presence.

Re: Delaware LLC

You are technically doing business in California because you are here, so you will need a California re-seller permit.
