Is it legal for a web domain company or employee to register and secure a domain name if you inquire to see if the name is available but do not register the name immediatly?

I don't know if this issue has ever been tested in the courts, but it seems highly improper and if a civil suit for damages or to obtain an injunction were brought, the aggrieved applicant might have a better-then-even chance of winning.
