As a Franchise Attorney I can say the following about "fair use." It is a defense that can be raised if you get sued for copyright infringement. It allows very limited use of copyrighted material without acquiring permission for things like commentary, criticism, news reporting, research, teaching, library archiving and scholarship. You can't simply use a copyrighted song as the background for a film. You really need to consult with a good intellectual property or franchise attorney in your area for specific advice about fair use before doing anything.
