Legal Question in Intellectual Property in California

Fair Use v Publisher

I want to use a song in a movie. The song is co-published. One of the publishers has agreed on price terms and conditions of use and is willing to issue me a sync license. The other publisher will not even speak to me. Is there any way I can use the song in my movie.

Re: Fair Use v Publisher

Generally, without knowing more facts, I'd say you probably need permission from both publishers. But there may be other specifics you have omitted that could change that. I suggest you consult with a competent entertainment attorney that can look at all the facts of your situation and advise you. Too often, people asking attorneys for advice do not realize the important of some small, "insignificant" element of their situation.
