I had an affair with a manager at work. It didn't work out, and we had a fender bender after the affair ended. I didn't see him coming in the parking lot and I hit his 1993 Honda Vigor. I didn't have insurance at the time, and he got an estimate of $2400 as well as he added $400 dollars to the estimate for hidden damages and any car rentatl that he might need. I gave him $2800. It has been 6 weeks, and he hasn't gotten anything fixed. Shouldn't I at least get the additional $400 dollars back for the hidden damages and car rental. It's obvious that he's not going to get it fixed. I think he's trying to railroad me because of the affair.

The recipient of insurance proceeds is not required to use them to repair the damage. Therefore, this person can use the money you paid him as he chooses. However, you should have obtained a full release, or at least a receipt showing the reason for the payment.
