Legal Question in Intellectual Property in California

Pierce Corporate Veil

My company just received a default judgment with an injunction. The plaintiff implies that they will attach personal property through liens. My company is an LLC, and I have not co-mingled assets. How can they pierce the corporate veil? Or is that standard language when going after the award.

Re: Pierce Corporate Veil

If the default judgment lists your name individually as a defendant, then the plaintiff has the right to attach your personal property.

In Pennsylvania, you also have the right to exempt your personal property from any attachment against your company's property. When the sheriff delivers notice of the attachment, follow the instructions on the notice carefully.

Of course, my professional advice is find an attorney immediately. Default judgments are a little unfair. The judge made a ruling without hearing your side of the story (because you didn't respond to the lawsuit). You should open the default and at least challenge the amount the plaintiff is claiming you owe.

In our country, you have a constitutional right to confront your accuser. You should use it.

Good luck.
