Use of Sports Photographs

I currently own a men's sportswear design firm. I want to create t-shirts that have old pictures of famous sports celebrities - some of the photos are of athletes while they are playing their respective sports and some of them are not. Do I need to seek permission from the respective athletes or from the person who took the photos before I print them on my tshirts? Will I be covered if I find out who took the photo and name the source on my shirts?

It depends on numerous factors, such as: (1) when the pictures are taken; (2) whether the athletes are still alive; and (3) what portion of copyright the photographer owns versus the athlete.

You should consult with a good intellectual property attorney to get an analysis.
