Legal Question in Intellectual Property in California
trademark
I need some help to make an argument for my company name as to why its not descriptive of my goods. I am being required to disclaim the name from my mark so anyone can use it. I.E. Staples is a common term yet it has a trademark.

Re: trademark
Sounds like you need a a lawyer to help you figure this out. Probably not a do-it-yourself project.
"staples" is not descriptive of "office supply store", it may be SUGGESTIVE, but by long-term use, it's acquired distinctiveness in the minds of the consuming public.

Re: trademark
Since you don't give your proposed trademark, it's difficult to comment. You are invited to call me and I will give you whatever comments I can offer.
