Legal Question in Intellectual Property in California

Website using my image and personal information

The website of my past employer still has an article on me claiming I am an employee of their's. The article features pictures of me and descriptions of where I live. It has been over 2 years since I left the company and I would like them to stop using my information to promote their company. I am currently in the same line of work and their claims are causing confusion for my prospective customers. I have requested, via email, for them to remove the article but they have ignored the requests. Thanks for your help.

Re: Website using my image and personal information

Sounds like you need to send a formal Cease and Desist letter, preferably from a law firm and be prepared to file and maintain a lawsuit for breach of your publicity rights as well as unfair competition. Without more facts, that's about all I can tell you. If you wish to pursue this, feel free to call me concerning this matter.

Re: Website using my image and personal information

You should have an intellectual property attorney write a strongly-worded "cease and desist" letter, threatening to sue for fraud, unfair business practices, potentially violation of publicity rights, etc.

Let me know if you would like more information.
