Legal Question in International Law in California

Can I sue someone in small claims court who is supposedly out of the country living in Japan but has a home and business in California? I have a promissory note that was due in February 2009 and he claims I can't sue him because he "lives" in Japan now.

If performance (i.e. payment) was to be made in California, or if the contract was executed in CA, you should be able to sue here. However, service is an interesting issue. You should research the "Hague Convention" to determine how to properly serve your the person who owes you the money.
