Legal Question in Juvenile Dependency in California
Can I sue CPS for false reporting and fabrication of evidence? I have vidio taped and audio taped every visitation with my children since their first ever overnight visit and my wife took my daughter to a therapist the day of her first overnight visit. This therapist had my daughter draw pictures of me naked in bed and going potty in bed at my house. This is impossible because she has never slept here. The therapist failed to report to CPS to stop the overnight visit but a report was made to CPS the day I brought the kid home instead. Then I was pulled in for a ex-parte hearing with all sorts of vile aligations after the first overnight ever. They weren't prepared for me recording the whole visit with a 4 camera DVR. The judge didn't believe my wife and didn't change orders. CPS then took over jurasdiction and social worker found the alligations true even though all the interviews with my children said there was no abuse Then after many hearings and defending against the lies the Social worker wrote in her reports my efforts paid off and the alligations were dismissed and the social worker was changed. This has been absolute hell and CPS has ruined so much of me an my childrens lives. There are so many mistakes CPS has made but to much to write. I keeped a journal of over 600 pages of all the spicifics and continued to audio and vidio record the entire visit every visit. I am wanting to sue CPS for falsifying evidence, omiting ex-culpatory evidence and violating my civil rights. Do I have a case?

Sounds to me like you do. Note that the statute of limitations is 6 months from the date of dismissal to file a claim against a government agency. So, if you are going to sue, you need to act quickly.
