Legal Question in Employment Law in California

In 09/2010 I had CTS surgery, just prior to my return I was in a auto accident which caused the sutures to reopen and new injuries. I returned to work in Nov on light duty/hrs. I have been in pain every since but felt I needed to get back before they didnt want me. Well I now have started Physical Therapy and have been placed on Disability for 4-6 weeks as my physical problems became worse. Now my employer has overnighted me a FMLA form to sign and return, since I didnt do this before in Sept and avoided any WC claim I just want to ask what am obligated to do and I do not want to sign anything and create problems or lack of security for myself later. My company is great but we have a terrible Controller who has little HR skills who also mentioned a couple weeks ago to my peers im a big liability. Any advice is appreciated, I am feeling like im behind the eightball.

The FMLA is designed to protect you. Go ahead and fill out the forms. It is unlawful for your employer to retaliate against you for taking time off under FMLA.
