Legal Question in Employment Law in California

1) 10-15-09 police (P) responds to 911 call. Woman (V) wants another woman (S) out from V residence.
242PC, $1500 bail, S spends night in jail.
from P/Rprt one may infer S was demanding "more money", S was residing and working at V address, there was
a language barrier. P saw a bruise on V arm, but no complaint from V was filed. no charges. bond exonerated.
2) Mar 2010 S receives Form1099 for $13000 from V. S files for Tax extension. S disputes 13000 wage.
V ought to have paid not 13000, but 18000. V shortchanged S (by a thousand) 2 prev/months, and called 911
when S confronted her the 3rd month 10-15-09. V paid cash.
3) quest: can S file for un-/under-paid $5000...w/Sm.ClaimCourt?
-who carries the burden of proof?

- V is a Philipino resident of Oakland, CA. 40y.old daycare owner. her name is Regina.
- S is a 40y.old pol/refugee from RUS. thus goes her 1st year in US. her 1st job. with barely a few English words.
- i am Ben...Rus-Eng interpreter. Forlorn Lana walked into Jewish Community Center in SF. JCC has no standing
in the matter.
