Legal Question in Employment Law in California

Accepted Starting Pay - Employer now renigs

I accepted a position starting $20.00hr + commission. Completed all employment forms and passed all pre employment testing. All contract forms state $20.00hr + comm. Two days after starting the Mgr. called me into his office to advise me that the main office will only pay me $16.50hr + comm. Is this legal? can I fight this some place? do I quite? and if so, will I get my unemployment back?

Re: Accepted Starting Pay - Employer now renigs

if this was offered to you, and you relied on it, you may have causes of action for breach of contract, misrepresentation, and possibly fraud. This case may make more sense in court and not the labor board. Normally companies do have the flexibility to reduce wages, but they need to act in good faith. doing this just a couple of days after you started doesn't seem like good faith, although I am not there, you are, and Idon't now all the circumstances.
