Legal Question in Employment Law in California

Admitted discrimination

I applied and was interviewed for a serving job at a restaurant. I didn't hear a reply so I went to speak to the manager. He told me he asked my interviewer not to hire me because of a previous job i held. He said he'd heard a rumor that my previous company's employees steal and so he wouldn't hire anyone from that company. Then he said he knew it probably didn't have anything to do with me, but oh well. Do I need some kind of evidence to take legal action, or is my word enough?

Re: Admitted discrimination

It doesn't sound -- from what you say -- that there's any basis for a lawsuit. You weren't discriminated against because of any intrinsic characteristic, such as race, sex, disability, sexual orientation, etc. If he told others you stole money from your company, that would be a different story. Good luck to you! -Robert F. Cohen, Esq.
