Legal Question in Employment Law in California
age discrimination
I believe I may have been a victim of age discrimination by the airport. I am 52 years old. I applied for an Airport Maintenance
Trainee position. Skills sought included building maintenance, emergency
training, etc. I feel I was unquestionably qualified for this position,
yet I did not even make it to the second round of interviews.I am a
licensed general contractor/handyman. I have worked for myself for 10
years doing major and minor remodeling, including electrical, plumbing,
carpentry, landscaping, etc. I am a volunteer for the air show and at the airport at Burning Man. Before I worked for
myself I worked in light and heavy manufacturing. I have industrial
maintenance experience. I have been certified a HAZMAT Incident Commander
and Technician, I have had First Responder training and served on the
company fire brigade. It would be curious to see who they eventually hire
for the trainee positions.

Re: age discrimination
Your suspicions, without facts to support them, are not enough to make a case of discrimination. As with any form of unlawful discrimination, the burden of proof is on the employee making the claim.
You will need someone to conduct an investigation to see if there is any evidence of discriminatory conduct. A good way to do this is to file a complaint with the California Dept. of Fair Employment and Housing or the U.S. Equal Employment Opportunity Commission. Either of those agencies can look into your case to see who they hired, whether that person's qualifications are less than yours, whether there is a pattern of favoritism towards younger workers, etc. Then, you may have something to talk about with an attorney.
