Legal Question in Employment Law in California

being asked to retire with no compensation offered

Can my supervisor ask me, out of the blue, if I want to retire? This is the 3rd time she has asked. My company has been firing a lot of people for not making a goal given us but they get severance and can collect unemployment. I am wondering if they are trying to get me to voluntarily retire so they don't have to pay ....another female age 62 was asked the same thing. I am 66 and have been at this employment for 6-7 years.

Re: being asked to retire with no compensation offered

It is likley OK for them to ask you if you are interested in retiring. However, it is not OK for your employer to single you out and put pressure on you to retire on the basis of your age in favor of other younger employees who have been there less. Doing so would be age discrimination.

It is difficult to conclude that you are being discriminated against with the facts you have provided.
