Legal Question in Employment Law in California
Auto expense allowance.
I am an outside sales rep with 100 percent of my salary coming from commissioned sales. My company does not pay car allowance or telephone allowance even thought we are expected to call in several times a day.
A law firm in Southern California was supposed to be working on a class action suit but after two years it still does not have class action status. If my company settles with the two individual who brought the suit, people like myself will be left out. The law firm will not return my calls so I am unable to find out the status of this action. If a settlement is made with the two founders of the suit, would it similar compensation be available to the several hundred people who would have qualified under class action status.

Re: Auto expense allowance.
Two years is not a long period of time with respect to class action litigation, but the law firm should return your calls or at least provide information as to how the case is progressing. The answer to your question would be dependent on the type of settlement made with the named plaintiffs.
I would be happy to speak with you concerning these issues and the potential representation of the class should the named plaintiffs settle without addressing class certification issues.
