Legal Question in Employment Law in California

Bail Reimbursement from on the job arrest.

My husband is a tow truck driver and was recently arrested while on the job. A man accused him of cutting him off on the freeway, when my husband reached a stop sign, the man got out of the car with a knife and tried to attack him. My husband had a fishing pole in the car and tried to get the knife out of the man's hand. When the police got to the scene they arrested both my husband and the man, because the man had cut's on his hands. The charges against my husband were dropped by the District Attorney's office, they considered it self defense. I had to post bail to get my husband out of jail. My question is, should the company reimburse us the cost of the bond due to the fact that he was on the job and found not at fault?

I do not believe this would fall within the employers' responsibility, however, tell him/her the facts, maybe you can work it out. 800-685-6950.

Employers must reimburse employees for business related expenses that are necessarily incurred on behalf of the employer. I doubt that the cost of the bond would fall into this category.
