Legal Question in Employment Law in California

Bonus payment

My old compensation plan paid a bonus based on thresholds (production) met during the year. The compensation plan states that you must be employed on the date of payment in order to be paid. Since this bonus pertains to commissions paid from the previous year aren't they still liable for payment. 1998 bonus paid in 1999

Re: Bonus payment

If your bonus payment is performance based you may be entitled to payment even though you were not employed on the date of payment.

File a claim for the unpaid bonus with your local office of the California State Labor Commissioner.
