My boss doesn't want to give me my tips from credit card transactions can I sue him ?

Tips belong to the employee in California. If the employer does not pay tips to the employee, then the employee has a wage claim that can be brought before the CA Labor Commission or in court -- usually small claims court.

Retaliation against the employee for pursuing the claim is also illegal. That, however, may not stop an employer from doing so.
