Legal Question in Employment Law in California
Does broken promises negate sign-on bonus
I am a technical engineer with a large San Francisco Bank. I was given a package for joining a pretty small unit in the organization. My employer had promised that certain parts of my job would be phased down and then out but none of that has come to pass. On top of this I had a case of direct harassment from a VP that made for a while an unbearable work environment. In the time period since I started I have had two bosses quit and now I am on my third. I have also found out that the group has now decided to change gears and head in a direction that is not my specialty. The job is not low stress. I am on call between two to four weeks a month. We did have a three person rotation but now we are down to two people in the group. I do receive calls sometimes 2, 3, 4 am. Some times multiple times a night.
The letter that I signed was obligating me for a year. It was for a small but unplayable amount of money that I could not afford in the time frame given by my employer.
I want to know that is there any thing that I can do to get out of this with out paying it back?

Re: Does broken promises negate sign-on bonus
Well, if they breached the agreement with you then you'd probably not be obligated to pay back. That is the argument that I would make.
