California: Equal insurance benefits to gay employees
My husband and I live and work in southern California. The company he works with (large corporation, headquartered in California) offers employees and their families subsidized health insurance through a variety of carriers (the company is not self-insured). Prior to our being married we checked and the insurance premiums paid by the employee for a registered domestic partner were about $350 per month more than that paid for a spouse. After our marriage, he added me as a spouse and he has now been told that he will still have to pay the higher contribution ($350 per month more than a 'straight' employee).
We understand that federal tax law still requires reporting of imputed income for benefits of same-sex spouses, however I do not understand how this company can offer unequal benefits under California law. The company states in its corporate policy that it does not discriminate, including on the basis of sexual orientation.
Any suggestions on where to go with a complaint in this matter are appreciated.
