Legal Question in Employment Law in California

I am a Califronia employee of an Illinois company. I am a commissioned sales rep who was overpaid for Q1 09. The company is reuqiring repayment, which i have no problem with, but i have recently resigned my position with them. Can the company withold the money I owe from my final paycheck without my consent?

No, it is illegal for an employer to use self-help by making unauthorized deductions from an employee's paycheck. Obviously, you will have to pay the money back. It might be wise to contact the company and propose a payment plan you can live wit h.
