Legal Question in Employment Law in California

Call back pay?

I have been working split shifts five days a week for about seven months now. It has come to my attention that I may be owed an extra one hour's pay each time I do a split shift called "call back pay." Is this true? This is the first time I have ever worked splits so I am not quite sure on this. Thanks

Re: Call back pay?

Most of the California Wage Orders require that additional pay of one hour at minimum wage shall be paid to any employee working a split shift. A split shift is defined as a work schedule which is interrupted by a non-paid, non-work period established by the employer, other than meals and break periods. I seem to recall that the employer can get a credit against the one-hour pay at minimum wage if the employee's wage rate is above the minimum wage. "Call back pay" is different. It is payable when the employer calls you back to work (on an unscheduled basis)after you have completed your scheduled hours.
