Legal Question in Employment Law in California

Class action suit

A union at my company filed suit on behalf of the workers and won a settlement. All claimants will be paid according to the days worked during a certain period. The excess money that is left from people that did not file a claim, I'm told will be split up among only the people that actually belong to the union. Is this legal? It seems to me that all claimants should get a share.

It may not be proper. I am not sure I can tell from your summary without looking at who was in the class, and looking at the judgment to determine the details of its disbursement. The attorney has an equal duty to everyone represented as the class. If you as a member of the class feel the attorney may not be properly complying with this duty, your recourse may be to bring in another attorney, such as myself, who would represent you and the class of people not being treated fairly, to make sure the judgment is disbursed properly.
