Collect unpaid deferred wages

The company owes me $20,000 of deferred wages representing 30% of my salary over a 10 month period. I my services with the Company were involuntary terminated July 2002. I went to the Commissioner of Labor, CA and they may rule the Company does not have to pay because they do not have the money.

Can I file multiple small claims, i.e., $5,000 for the first 3 months and file 3 subsequent individual claims for the balance?

Multiple claims would not be the best approach. You should speak to an attorney well versed in wage and hour law who may decide that it would be more prudent to file a lawsuit. Good counsel can also determine the financial condition of the employer to help decide whether it is prudent to go after the sums owed.
