Collecting payment for employment
I had worked as a temp for a dental office in the area. After two days of employment I decided to accept a position at another office. Three months have passed and I have not received my pay for 19 hours of work at the original office despite multiple phone calls to the office. I want to file a complaint against the office and the agency that referred me to them in addition to getting the money owed to me. What are my legal rights and how do I collect?

File a wage claim against the employer with the California Labor Commissioner or a small claims case in your local court. Ask for waiting time penalties under Labor Code section 203. If the agency was the one who was supposed to pay you, name them to.

You are, under California law, to get your final pay within one working day of the termination or notice. You should look in the white pages under "Government" and contact your local labor board and file a complaint. They can help get your paycheck, plus get penalties against the employer for having to wait so long.
