Legal Question in Employment Law in California
Commission Owed?
I was fired from my job on the 12th of March and was still owed commission. Being that I got paid commission every quarter and was fired before the quarter was finished my ex-employer is stating that the commission earned is not owed to me. Is it legal for them to hold the wages earn under these circumstances?

Re: Commission Owed?
Generally, commissions are owed when earned. Thus, it is very likely that the commissions you already earned based on your performance are due to you, and withholding those commissions just because you didn't reach the very end of the quarter is an unlawful practice.
