Can a company disqualify a driver that has been charged with a moving violation but has not been convicted, and cutting the hours and pay depending on the outcome of the court?

Unless you have a personal or union contract, they can do that for any reason or even just arbitrarily.

I assume the driver is an at-will employee. Under this assumption, yes, the comany can even terminate the driver without waiting for the conviction.
