Is Company Liable?

If an hourly employee leaves company property for lunch without clocking out and gets in a accident is the company liable?

Possibly. If the employee claims or if an investigation discloses/he was on a company mission there may be liability to third parties. Since there is no clear documentation that the emploee was not "on the clock" a claim might be made.
