Legal Question in Employment Law in California

Company sends me severance agreement. HR mgr clarifies in writing that amount will be paid in full and she is fully responsible for negotiation. I sign the agreement. HR Mgr states in writing that she will send fully signed agreement after it is reviewed. Company attorney calls a week later and states that company wants to split the amount; pay half now and pay half in January 2014. Company attorney wants me to sign an amendment that splits the amount. Is company legally obligated to pay full amount now?

Yes, IF an agreement was reached with regard to when it would be paid. Even an oral agreement between you and the company HR person would bind them to pay when the two of you agreed it would be paid.
