Legal Question in Employment Law in California

contract

My boss asked me to sign a contract, forbidding me from opening a similar tutoring center after terminating the work, within a same city. I cannot even work for a similar tutoring center in 5 years after the contract, according to him.

I would like to know whether this type of contract is legal, and whether he can actually go for a lawsuit if I breach the contract.

He said i need to pay him back the whole saralies upto the point, if I break the contract.

Generally, a non-compete contract is unenforceable in California. However, there are exceptions to this general rule. You should have an Attorney review your non-compete and if necessary send a letter to your old employer.
