Legal Question in Employment Law in California

I was contracted to do work for a client that was completed, but the company I contracted through is not paying me. They have sent me a partial payment, but said they haven't been paid themselves. I know this is not the case and other contractors are also not getting paid as agreed. I did re-invoice them and included late charges as defined the contract (their contract). I have also made phone calls, only to be told the people I wanted to speak to are in meetings and left messages on voice mail. What are the next steps I could or should take to get my agreed upon payments.

Hello.

Even if the company was not paid, this is not an excuse or justification for their failure to pay to you. At this point, you have two options - to bring a claim in your local labor board (DLSE) or sue for breach of contract and failure to pay for services provided. The strategy should be chosen depending upon the details of your contract and the amount in dispute.

Thanks, and feel free to follow up.
