Legal Question in Employment Law in California
My daughter was laid off her last job several months ago and has been seeking employment. Now doctor wants to put her out on short term disability. She is a volunteer with a new non-profit organization that recently filed for incorporation using my daughter's tax id number. Once the incorporation papers come through 501-C-3 status will be sought. My daughter was told by an organization board member who provides pro-bono legal services to the organization that because her tax id number is associated with the organization she would not be eligible for benefits under California's SDI program. As this area of law is not his specialty, I am concerned my daughter has been given inaccurate information and time is of the essence due to the window of opportunity for her to apply for SDI. Is the information she was given correct? If yes, does she have any options?

It is inexcusable for the organization to use her SSN and its tax id. Getting a TIN is a simple "no brainer." She should demand that the organization get it's own TIN immediately and stop using hers.
